Please read section 2 and section 8. AbScan is a fitness tracking app, not a medical device and not a source of medical advice. Its body composition figures are estimates produced by an AI model from a photograph, and they can be wrong. Talk to a doctor before starting any exercise or nutrition programme.
Welcome to AbScan. These Terms of Service ("Terms") are an agreement between you and AbScan ("we", "our", or "us") covering your use of the AbScan iOS application and this website (together, the "Service"). By downloading or using AbScan, you agree to these Terms. If you do not agree, please do not use the Service.
AbScan lets you photograph your midsection, receive an estimated read of your abdominal development across six zones, and follow a training and nutrition plan built around the zones scored lowest. It also lets you photograph meals to receive an estimated nutrition breakdown, log your weight and workouts, and track progress over time.
Some features require an active paid subscription. We may change, add, or remove features over time.

Never disregard professional medical advice, or delay seeking it, because of something you read in AbScan.
You must be at least 13 years old to use AbScan, or at least 16 where your local law sets that minimum. If you are under 18, you may use AbScan only with the permission and supervision of a parent or guardian, who agrees to these Terms on your behalf. You must be able to form a binding contract where you live.
AbScan is free to download. Full access requires a subscription, sold through the Apple App Store.
We may change prices for future billing periods. Where required, we will give you notice and the chance to cancel before a new price applies.
Your photographs are yours. You keep all rights to them.
You grant us only the limited permission needed to run the feature you asked for: to transmit an image you choose to scan to our AI provider, have it analysed, and return the result to you. This permission exists for as long as it takes to process the request. We do not use your images for marketing, we do not publish them, and we do not use them to train models. Our processing of images is described in the Privacy Policy.
You confirm that any photograph you submit is of yourself, or of a person who has given you permission, and that you have the right to submit it. Do not submit images of other people without their consent, images of minors, or unlawful content.

We may suspend or restrict access where the Service is used in ways that breach these Terms or threaten its operation or other users.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use AbScan on Apple devices you own or control, in accordance with the App Store Terms of Service. We and our licensors retain all rights in the Service, including its software, design, text, and trademarks. These Terms grant you no rights in them beyond that licence.
Physical exercise carries inherent risk, including the risk of serious injury. You use AbScan and follow any plan it produces voluntarily and at your own risk. You are responsible for exercising within your own limits, using correct form, and stopping when you should. To the fullest extent permitted by law, you assume all risk arising from exercise or dietary changes undertaken in connection with the Service.
We aim to keep the Service running but do not guarantee it will be uninterrupted, timely, secure, or error free. Features that rely on our AI provider may be unavailable, delayed, or degraded for reasons outside our control. We may modify or discontinue the Service, in whole or in part, at any time.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that any score, estimate, plan, or recommendation is accurate, complete, or suitable for you, or that use of the Service will produce any particular result.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or in connection with your use of or inability to use the Service, however caused and on any theory of liability.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or twenty five United States dollars.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Service, or content you submit.
These Terms are between you and us, not with Apple, and Apple is not responsible for AbScan or its content. Apple has no obligation to provide maintenance or support for AbScan. If AbScan fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price where applicable; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to AbScan, including product liability, regulatory, or intellectual property claims. Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.
You may stop using the Service at any time by deleting the app, remembering to cancel any subscription separately through Apple. We may suspend or terminate access if you breach these Terms. Sections that by their nature should survive termination will survive, including sections 8 through 12.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute not required to be resolved elsewhere. If you are a consumer resident in a country whose law gives you the protection of your local courts and mandatory local consumer law, nothing here removes that protection.

We may update these Terms from time to time. Changes will be posted here with a new effective date. Continuing to use the Service after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the Service and cancel any subscription.
If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
